1. Agreement to these Terms

These Terms & Conditions (“Terms”) govern your access to and use of homele.com and the Homele mobile applications (together, the “Service”), operated by Homele (“we”, “us”, or “our”).

By accessing or using the Service you agree to be bound by these Terms. If you do not agree with any part of them, please do not use the Service. Your use of the Service is also governed by our Privacy Policy.

2. What Homele is

Homele is an advertising platform for real estate in Iraq. We publish listings for properties offered for sale or rent, development projects, land plots, and the profiles of the agencies and agents who advertise them.

Homele is not a real estate broker, agent, or party to any transaction. We do not own, sell, rent, inspect, or manage the properties advertised on the Service, and we are not involved in the agreements reached between users, advertisers, and property owners.

3. Listing content and accuracy

Listing information — including prices, areas, specifications, photographs, and availability — is supplied by advertisers, not by Homele. While we take reasonable steps to keep the Service accurate and current, we do not warrant that any listing is complete, accurate, or still available.

You should independently verify every material fact — including ownership, legal status, measurements, and price — directly with the advertiser and through your own advisers before entering into any agreement or making any payment.

4. Using the Service

You agree to use the Service lawfully and not to: publish false, misleading, duplicated, or fraudulent listings; advertise a property you are not authorised to advertise; harvest, scrape, or copy content or data in bulk; interfere with or place unreasonable load on the Service; attempt to gain unauthorised access to any part of it; or use the Service to harass any person or to send unsolicited messages.

We may remove content, or suspend or terminate access to the Service, where we believe these Terms or applicable law have been breached.

5. Advertiser responsibilities

If you advertise on Homele, you confirm that you are entitled to advertise the property, that the information and images you submit are accurate and your own or properly licensed, and that your listing complies with applicable law. You remain responsible for keeping your listings up to date and for removing them once a property is no longer available.

By submitting content you grant Homele a non-exclusive, royalty-free licence to host, display, reproduce, and distribute that content for the purpose of operating and promoting the Service.

6. Intellectual property

The Service, including its design, software, text, graphics, and the Homele name and logo, is owned by Homele and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works from the Service without our prior written permission, except for the ordinary personal use of viewing and sharing individual listings.

7. Third-party links and services

The Service may contain links to third-party websites, applications, or services, including those of advertisers and assistant platforms through which Homele listings can be searched. We do not control and are not responsible for the content, policies, or practices of those third parties.

8. Disclaimers

The Service is provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any listing or search result will meet your requirements.

Nothing on the Service constitutes legal, financial, investment, or valuation advice.

9. Limitation of liability

To the fullest extent permitted by law, Homele shall not be liable for any indirect, incidental, special, or consequential loss, or for any loss of profits, data, or opportunity, arising out of or in connection with your use of the Service, any listing, or any dealings with advertisers or other users.

10. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the effective date above and, where the change is material, provide a prominent notice on the Service. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

11. Governing law

These Terms are governed by the laws of the Republic of Iraq, and the competent courts of Iraq shall have jurisdiction over any dispute arising from them, without prejudice to any mandatory consumer rights available to you under the law of your country of residence.
